Form 5500 Deadline Is July 31

Each year, employers subject to ERISA must electronically file an annual report (Form 5500) for each employee benefit plan they maintain, unless a filing exemption applies. Employers with employee benefit plans that operate on a calendar-year basis must file their annual reports for 2025 with the U.S. Department of Labor (DOL) by July 31, 2026.

Federal District Court Upholds Process for Assessing ACA Pay-or-Play Penalties

This year, the U.S. District Court for the Southern District of Florida ruled that the IRS may assess pay-or-play penalties 

without the HHS first providing the employer with a certification. Earlier, the U.S. District Court for the Northern District of Texas reached the opposite conclusion, creating a conflict over which agency (i.e., the IRS or HHS) can issue the penalty certification.

HSA/HDHP Limits Will Increase for 2027

On May 29, 2026, the IRS released 

Revenue Procedure 2026-24 to provide inflation-adjusted limits for health savings accounts (HSAs) and high-deductible health plans (HDHPs) for 2027. The IRS is required to publish these limits by June 1 of each year.
